Balanced and Fair

Look, I don't like Al Franken, and I won't read his new book, but this is just stupid:

Fox News Channel has sued liberal humorist Al Franken and the Penguin Group to stop them from using the phrase "fair and balanced" in the title of his upcoming book.

Filed Monday in Manhattan, the trademark infringement lawsuit seeks to force a Penguin publisher, Dutton books, to rename the book, "Lies and the Lying Liars Who Tell Them: A Fair and Balanced Look at the Right." It also asks for unspecified damages.

Fox News registered "Fair & Balanced" as a trademark in 1995, the lawsuit said.

Franken's "intent is clear — to exploit Fox News' trademark, confuse the public as to the origins of the book and, accordingly, boost sales of the book," it said.

"Confuse the public as to the origins of the book"? Um, no. If I put a Nike swoosh on my shoes and try to sell them, that's confusing the public as to the origins of my shoes. Franken isn't trying to fool people into selling them a FOX product. He's satirizing them (not very well, mind you...he's making fun of people calling themselves "fair and balanced" when he thinks they're obviously not, but I don't see any liberal liars on the cover of his book).

Anyway, I think we might all be able to agree this is dumb. But maybe not. Anybody think there's anything legit about this?
