2004-02-24 9:27 PM I survived today Previous Entry :: Next Entry Mood: Proud Read/Post Comments (0) I am so happy today is almost over. Last night at this time it was me and imodium all the way. I was literally thinking of all the worst possible permutations of bar questions. Creppy cross-overs with bad lawyers, or bad judges (con law, civ pro or evidence). Ugh, every possible scenario was going through my mind. I only slept about four hours. My stomach grumbled all night.
To make matters worse I was severly depressed, feeling like the worst mom in the world. Spencer was sick all weekend so Monday my dad took him to the doctor and he had an ear infection in both ears and bronchitis! Then Stephanie came home from school monday with ear pain. I promptly called for a doctor's appointment and yet another ear infection and a throat infection. Thank god Steve's sister came to help out. I was feeling like I should just go home and crawl in bed with steph and hug her all night. I was so so sad. Thank god Sean doesn't seem to be sick yet. Matthew is just fine. I am so proud of him right now. More on that another day! But right now it's a different story. I have renewed energy, no funky thoughts. Just happy it's 1/3 over. I called home at lunch and stephanie was asleep and spencer was feeling a lot better. Thank god for antibiotics. So all my awful scenarios did not come to pass. This was the first time I took the exam on laptop. It's so funny, I don't know what I was thinking in not investing in a laptop sooner. What a difference. There is no fricken way I could have completed the performance exam today if I would have hand written. The performance was writing a letter to an insurance company and a memo to the client. We had to "persuade" the insurance company to re-calculate our client's insurance risk for a mountain biking program they wanted to add at their lodge. Then we had to write a memo telling the lodge how to implement the program to stay within the protections of statutory immunity for personal injuries of patrons while engaging in recreational activites. It was kind of killer but I was pretty prepared. I just paced myself. I analyzed the statute, applied the cases, told the insurance company to shove it (well, not really), then told our clients what they had to do to keep the immunity. Again, no way I could have done it w/o the laptop. Gee, last summer's performances were a piece of cake compared to this one, so I hope everyone thought it sucked and did poorly cuz I need the extra points! The essays were actually a little straight forward so I hope I didn't miss anything! The first one was an evidence crim pro cross over. I sat there for a few minutes and had to make sure that's what it was. The first call was a little funky, but it was pure evidence. The next calls were just applying the 4th and 5th amendments. What a gift! The second one was Community property or CP. There was a little twist with Herb the husband moving in with Ann. Then they held themselves out as married, with Ann taking Herb's last name. They bought property as "husband and wife." It was fun. I got to trash Ann for being a slut and Wendy (wife) still got 1/2 of all they bought lol. I don't think I had seen a fact pattern like that before, but I didn't freak. I just isolated the property, characterizied it, divided it, applied presumptions, etc. I was ready for that one. The last one was a pure professional responsibility. PR. Another gift. I just tried to find as many things wrong as I could that the lawyer did. It's kind of hard to shine on those sometimes if you don't make distinctions between model rules but I tried to do what I could. The problem is that I think everyone else must have thought those were easy if I did. Oh well, I finished each one and tried to be analytical and use headings and all. So at least for today it wasn't a total blow-out. I'm expecting Thursday to be killer. Usually the Thursday performances are much harder - Yikes. As for essays I'm still expecting con law and civ pro and maybe contracts or property or a pure remedies. Oh well, I'll worry about that tomorrow night!
